The CE marking is a key indicator (but not proof) of a product’s compliance with EU legislation and enables the free movement of products within the EEA and Turkish market, whether they are manufactured in the EEA, Turkey or in another country.
The CE marking indicates conformity with the requirements of ALL related EU-legislation for this product.
Definition and role of the CE marking
The CE marking is an essential indication (but no evidence) that a product complies with all applicable EU harmonisation provisions, e.g. EU directives/regulations, and thus enables the free movement of goods in the European Economic Area, EEA.
- The CE marking is a legally valid conformity marking and is neither a quality mark nor a marketing tool but they signify that products sold in the EEA have been assessed to meet high safety, health, and environmental protection requirements
- CE marking does not indicate that a product was made in the European Economic Area, EEA.
- The CE marking indicates conformity with the requirements of ALL related EU-legislation for this product.
- By affixing the CE marking on a product, a manufacturer is declaring, on his sole responsibility (and irrespectively of whether a third-party has been involved in the conformity assessment process), conformity with all of the legal requirements to achieve CE marking.
- CE marking is the visible consequence of a whole process comprising conformity assessment in a broad sense and indicates that a product is declared by the manufacturer as in conformity with Union harmonisation legislation.
- The CE marking must be affixed before any product subject to it, is placed on the market
CE Marking surveillance
The national market surveillance authorities are responsible for the proper connection and can impose sanctions if
- a CE marking has been affixed to a product that does not or does not fully comply with the harmonisation legislation.
- a CE marking has been affixed to a product, but no legal provision exists for this
- a CE marking is missing on a product
- a CE marking has been affixed incorrectly
- a CE marking does not correspond to the regulations in terms of shape and size.
Member States must take appropriate measures both to prevent misuse and improper use of the CE marking and to remedy such cases.
