Guideline related to: Article 4 paragraph 1 (a), Article 13 paragraph 2

Question

If a vessel contains a fluid which meets the conditions of the introductory paragraph to Article 4, paragraph 1(a)(i) (e.g. air) and a liquid which meets the conditions of the introductory paragraph to Article 4, paragraph 1(a)(ii) (e.g. water) - how shall the vessel be classified?

Answer

Article 13, paragraph 2 states that the classification shall be on the basis of the fluid which requires the higher category. The total volume (V) of the vessel, as defined in Article 2 (10), shall be used to determine the conformity assessment category, not the actual volume occupied by the individual fluids at any particular time.
